Estendere la portata dei diritti umani internazionali per includere i diritti economici, sociali e culturali come la cosiddetta seconda generazione di diritti umani è emersa verso la fine del 19° secolo, ma da allora ha ricevuto un rilievo speciale principalmente attraverso le attività dell’International Labour Organizzazione delle Nazioni Unite per l’educazione, la scienza e la cultura (OIL) e l’Organizzazione delle Nazioni Unite per l’educazione, la scienza e la cultura (UNESCO). Si ricorda anche che c’è stato un tempo in cui il controllo e la regolamentazione dell’economia da parte del governo erano quasi inesistenti negli Stati Uniti d’America, perché ciò era visto come una manifestazione del comunismo. Tuttavia, il New Deal avviato dal presidente Franklin D. Roosevelt (1882-1945) per superare gli effetti devastanti della Grande Depressione degli anni ’30 ha portato un cambiamento radicale in questo senso. Il New Deal è stato progettato per stabilizzare l’economia attraverso il controllo legislativo e le iniziative governative, e il diritto commerciale è diventato quindi una componente importante della disposizione legale americana. Le direttive dell’ILO hanno contribuito allo sviluppo delle iniziative del New Deal. Anche l’UNESCO ha svolto un ruolo di primo piano in tutto il mondo.
