A extensão do alcance dos direitos humanos internacionais para incluir os direitos econômicos, sociais e culturais como a chamada Segunda Geração de direitos humanos surgiu no final do século XIX, mas desde então recebeu destaque especial principalmente por meio das atividades da Organização Internacional do Trabalho Organização das Nações Unidas para a Educação, a Ciência e a Cultura (UNESCO). Recorda-se também que houve um tempo em que o controle governamental e a regulação da economia eram quase inexistentes nos Estados Unidos da América, porque isso era visto como uma manifestação do comunismo. No entanto, o New Deal iniciado pelo presidente Franklin D. Roosevelt (1882-1945) para superar os efeitos devastadores da Grande Depressão da década de 1930 trouxe mudanças radicais a esse respeito. O New Deal foi projetado para estabilizar a economia por meio de controle legislativo e iniciativas governamentais, e a lei comercial tornou-se, portanto, um componente importante da disposição legal americana. Diretrizes da OIT contribuíram para o desenvolvimento das iniciativas do New Deal. A UNESCO também desempenhou um papel de liderança em todo o mundo.
