Con l’aumento della complessità dei mercati finanziari globali ed europei, l’UE si trova ad affrontare nuove sfide poste da pratiche illecite come il riciclaggio di denaro e il finanziamento del terrorismo. Alla luce di questi sviluppi, la nuova Autorità antiriciclaggio cercherà di migliorare il quadro normativo europeo esistente. Questo libro esplora l’equilibrio tra l’autonomia delle agenzie dell’UE, l’efficacia operativa e i vincoli legali imposti dalla Dottrina Meroni, che regola la delega di potere dal 1958. L’evoluzione della dottrina viene tracciata dalla sua nascita fino al caso cruciale del Banco Popular del 2024, che ha ridefinito alcuni principi di delega. Infine, l’analisi si concentra sul lancio dell’AMLA previsto per il 2025, valutando i suoi poteri di vigilanza, amministrativi e sanzionatori rispetto agli standard di delega contemporanei. Inoltre, vengono presi in considerazione i meccanismi per garantire il controllo democratico e la legittimità delle decisioni dell’AMLA. Evidenziando sia i punti di forza che le potenziali debolezze dei meccanismi di controllo in questione, il libro offre spunti di riflessione sul ruolo delle agenzie europee nella regolamentazione finanziaria, con un occhio di riguardo alla relativa sfida di mantenere la responsabilità democratica.
