Administrative law decides more of daily American life than almost any bill Congress passes. This guide explains how federal agencies get their power, how they use it, and how courts and Congress push back, written in plain language for readers without a law degree. Congress passes a few hundred laws in a typical year. Federal agencies issue thousands of rules in that same span, covering what goes into your food, how clean your water has to be, and what safety features your car needs. The chapters work through: - Where agency authority comes from: enabling statutes, the Administrative Procedure Act of 1946, executive orders, and the non-delegation doctrine that asks whether Congress can hand its lawmaking power away at all - Executive agencies against independent ones like the Federal Reserve, including who appoints agency heads and when a president can fire them - Notice-and-comment rulemaking start to finish, plus formal rulemaking, interim final rules, emergency shortcuts, and why one regulation can take years to write - Administrative law judges, consent decrees, civil penalties, licensing, and subpoena power - The Chevron doctrine, its 1984 rise, and its end in 2024 - Judicial review: standing, arbitrary and capricious review, hard look review, and exhaustion of remedies - Oversight mechanisms anyone can use, including Freedom of Information Act requests, the Congressional Review Act, inspector general investigations, and whistleblower protections - Environmental rules at the EPA, financial rules at the SEC, labor regulation, and the fights running right now over the major questions doctrine, artificial intelligence in agency decisions, and deregulation Written for law students facing the course for the first time, paralegals and compliance staff who need the framework straight, business owners stuck in a permit process or facing an inspection, agency employees who want to see where their daily work fits, and anyone curious about why so much of government runs through offices no one voted for.
