Część B, zatytułowana Państwo prawa a sprawiedliwość przejściowa, omówi najpierw genezę sprawiedliwości przejściowej, określi, co się pod nią rozumie, jej cele, poziomy, zasady, podmiot reparacji (w tym przypadku ofiarę), jej znaczenie dla umacniania państwa prawa, elementy polityki tego typu kompleksowej sprawiedliwości, a następnie przeanalizuje, dlaczego jest ona istotna w rozwiązywaniu problemu zbrodni popełnionych w państwie prawa.
