Dziecko jest istotą wrażliwą i dlatego musi korzystać ze szczególnej ochrony pod każdym względem, zwłaszcza w czasie konfliktów zbrojnych. Państwa afrykańskie zgadzają się z tym twierdzeniem, biorąc pod uwagę teksty uniwersalne, międzynarodowe, regionalne, subregionalne i krajowe, które ratyfikowały i zatwierdziły. Ponadto wprowadzone działania i strategie potwierdzają zaangażowanie państw. Jednak pomimo tych działań, gdy przeprowadza się szczegółową analizę sytuacji praw dziecka w krajach ogarniętych konfliktem, takich jak Mali i RCA, okazuje się, że nadal dochodzi do licznych i coraz częstszych naruszeń praw dziecka. Namacalnym przykładem jest zjawisko dzieci-żołnierzy obserwowane w Mali i Republice Środkowoafrykańskiej. Ponadto działania zewnętrzne podejmowane z jednej strony przez społeczność międzynarodową, a z drugiej przez organizacje pozarządowe i CSO pozwoliły zrozumieć, że problem ma charakter endogeniczny i egzogeniczny. Dlatego też, aby unicestwić zjawisko dzieci-żołnierzy w tych dwóch krajach, konieczne jest precyzyjne przeredagowanie odpowiednich tekstów, jak również zastosowanie bardziej odstraszającej sankcji.
