A eleição de determinados líderes políticos ao poder configura-se, na atualidade, como o ponto culminante de um fenômeno que ressignifica a democracia, afastando-se dos princípios fundamentais próprios da democracia liberal, corroendo a ordem constitucional e, sobretudo, comprometendo a proteção dos direitos humanos, em especial aqueles inerentes aos refugiados e aos requerentes de refúgio. Nesse contexto, a relação entre governos populistas e atual crise dos refugiados mostra-se essencialmente conflituosa, uma vez que tais governos utilizam mecanismos de diversa natureza - jurídicos, políticos, etc - para restringir o ingresso em seus territórios e o acesso à proteção internacional. Portanto, a ameaça populista, diante das lacunas do Direito Internacional, favorece práticas estatais que violam o princípio de non-refoulement e os direitos dos refugiados. Assim, ressalta-se a necessidade de observância dos instrumentos internacionais de proteção dos refugiados, muitos deles integrados ao jus cogens, cujo descumprimento pelas práticas populistas, pode gerar a responsabilidade internacional do Estado.
