Как и закон, прецедентное право является источником права. Действительно, закон иногда бывает неполным, неточным и молчаливым, и судьи должны принимать решения и выносить постановления с помощью правовой нормы, которая не вытекает из какого-либо текста, или вытекает из толкования этого текста, или адаптирована из него. В странах общего права прецедентное право играет особенно важную роль, поскольку решения апелляционных судов являются обязательными для нижестоящих судов, рассматривающих другие дела, и эти же апелляционные суды связаны своими собственными решениями. Это правило происходит от латинской фразы stare decisi ('стоять на решении'). В отличие от этого, страны с романо-германской традицией очень неохотно придают значение прецедентному праву. Это различие обусловлено стремлением этих правовых систем не позволять судам создавать право, а оставить эту функцию законодателю.
