L’immunité diplomatique, initialement indissociable des privilèges, a été traitée comme un seul et même concept. Au XVIe siècle, l’immunité pénale est apparue, suivie par l’immunité des locaux de mission au XVIIe siècle. Ces principes ont joué un rôle essentiel dans l’élaboration du droit international moderne. Les agents diplomatiques jouissent de privilèges et d’immunités plus importants que les agents consulaires, ce qui reflète la nature politique de la diplomatie par rapport à la nature administrative des fonctions consulaires. Les agents consulaires jouissent d’une immunité civile limitée, principalement pour les actes officiels. Ils sont responsables des contrats personnels ou des dommages, comme le prévoit l’article 45 de la Convention de Vienne sur les relations consulaires.
