La macchinosità della procedura prevista dal dahir del 1955 in materia di locazioni commerciali ha contribuito in modo sostanziale alla complessità del contenzioso in questo settore, che era la principale critica mossa al testo precedente. Di fronte a questa constatazione, i redattori della nuova legge 49-16 hanno prestato particolare attenzione alle disposizioni procedurali al fine di garantire una certa celerità alla procedura, che costituirà senza dubbio il suo principale elemento di attrattiva. Il legislatore marocchino ha quindi compiuto un nuovo passo nello status della locazione commerciale, ponendo fine a tutte le incertezze e alla mancanza di prevedibilità che l’hanno contraddistinta. L’aggiornamento della legislazione comporta necessariamente una revisione completa dello statuto della locazione commerciale, al fine di porre rimedio alle disfunzioni riscontrate e di favorire l’insediamento di nuove imprese, garantendo al contempo quelle già insediate.
