Um dos elementos fundamentais da União Europeia é, sem dúvida, a expectativa de que um mercado interno europeu forte e funcional traga benefícios económicos para todos os envolvidos. Um paradigma básico neste contexto é a suposição de que uma legislação uniforme pode ajudar a alcançar o objetivo acima mencionado. A chamada Diretiva UGP visa uma harmonização jurídica mais abrangente da regulamentação das práticas comerciais desleais. Além do objetivo de estimular o mercado interno europeu, a diretiva estabelece como objetivo adicional um elevado nível de proteção dos consumidores. A regulamentação da diretiva refere-se exclusivamente a casos jurídicos relativos às relações entre empresas e consumidores. Os Estados-Membros são obrigados a transpor as diretivas da Comissão Europeia. A fim de alcançar um elevado grau de harmonização jurídica, a diretiva UGP foi elaborada pela Comissão como uma harmonização total. Este trabalho dedica-se aos desafios da transposição para o direito nacional, com especial atenção ao direito alemão.
