Die Europäische Union hat bei der Herausbildung ihres Umweltrechts einen Paradigmenwechsel vollzogen. Die Unesco erklärte 1989 in Vancouver (Kanada): 'Das Überleben des Planeten ist nunmehr ein wichtiges und unmittelbares Anliegen (...). Jede Verzögerung bei der Schaffung eines weltweiten ökokulturellen Friedens wird die Kosten für das Überleben nur erhöhen'. Im Zuge dieser Warnung haben die USA und die Europäische Union zunächst strenge Haftungsregelungen für Umweltschäden eingeführt. Das Verursacherprinzip, das Ende des 20. Jahrhunderts aufkam und von den USA inspiriert wurde, schien zunächst am besten geeignet, um eine fast systematische Behebung von Schäden zu gewährleisten. Die Europäische Union erkannte jedoch die negativen finanziellen Folgen des Prinzips und seine rechtliche Anfälligkeit und wandte sich ab 2004 dem Prinzip der Verschuldenshaftung zu.
