Quando viene commesso un reato, la vittima non può farsi giustizia da sola, ma il reato provoca alla vittima danni fisici, materiali e psicologici molto gravi.Nella RDC, quando viene commesso un reato, ogni parte lesa può dichiararsi vittima e intentare un’azione di risarcimento danni davanti al tribunale, costituendosi parte civile nel procedimento penale.Al termine del processo, la vittima può ottenere un’ordinanza del tribunale che imponga all’imputato di risarcire i danni causati.Il tribunale può, ad esempio, ordinare all’imputato di pagare una certa somma di denaro alla vittima a titolo di risarcimento danni. Di conseguenza, la vittima diventa creditore di una sentenza. Tuttavia, l’ottenimento di una decisione giudiziaria non garantisce in alcun modo che il pagamento venga effettuato. La vittima che ha vinto la causa deve intraprendere altri passi molto complessi, questa volta per far rispettare la decisione del tribunale che ordina al convenuto di pagare una somma di denaro a titolo di risarcimento danni.
