A questão da propriedade dos direitos de autor das obras cinematográficas tornou-se controversa no Canadá em 1993, durante a preparação do projecto de lei C-115 que implementava o Acordo de Comércio Livre da América do Norte: o governo federal propôs que o realizador fosse o autor da obra cinematográfica e que o produtor fosse o primeiro proprietário dos direitos de autor da obra. O protesto maciço dos autores impediu a adopção desta proposta e o legislador canadiano optou, em vez disso, por manter o status quo relativamente a esta categoria de obra: a obra cinematográfica continua a ser, ao abrigo da Lei dos Direitos de Autor, equiparada a uma obra dramática e o autor é a pessoa que a criou. A particularidade da obra audiovisual ou cinematográfica reside no facto de envolver uma pluralidade de autores que colaboram na criação da obra comum. Na cena internacional, a noção de autor, para esta categoria de obra, evoluiu segundo princípios opostos consoante se trate de um país 'de direito de autor' ou de um país 'de direitos de autor'.
