Zusammenfassung: Da sie das Produkt des politischen Willens der internationalen Gesellschaft und der öffentlichen Meinung ist, ist die Verrechtlichung des internationalen Strafrechts das Ergebnis eines langen Prozesses. Sie wurde erst nach dem Zweiten Weltkrieg mit den Nürnberger und Tokioter Prozessen effektiv in Gang gesetzt. Da seine Entwicklung durch den Kalten Krieg unterbrochen wurde, wurde die internationale Strafjustiz schließlich mit dem Zusammenbruch des Ostblocks und angesichts der Grausamkeit der Verbrechen, die in den jüngsten Konflikten begangen wurden, zur Realität. In den 1990er Jahren entstanden die Internationalen Strafgerichtshöfe, aber die letzte Innovation in diesem Bereich ist zweifellos der IStGH, dessen Statut am 17. Juli 1998 in Rom angenommen wurde.
