Inhaltsangabe:Gang der Untersuchung: Die Arbeit behandelt die Richtlinie über den elektronischen Geschäftsverkehr (erlassen im Juli 2000), die bis Januar 2002 innerhalb der Europäischen Union umgesetzt werden muss. Im ersten Teil wird die Richtlinie folgendermaßen dargestellt: Zuerst wird der Anwendungsbereich bzw. Ausnahmen davon behandelt, wobei auch auf die betroffenen Grundfreiheiten eingegangen wird. Danach wird die Zielgruppe der Richtlinie definiert. Darauf folgt der Inhalt der Richtlinie, der vorerst in allgemeine Informationspflichten und Werbung geteilt wird worauf eine Analyse sämtlicher Konstellationen von Vertragspartnern erfolgt (b2b, b2c, c2c). Dabei soll vor allem dargestellt werden, was den elektronischen Vertrag vom konventionellen Vertrag unterscheidet. Danach wird die Umsetzung der Richtlinie behandelt und ausführlich auf eine eventuelle nicht zeitgerechte Umsetzung eingegangen (unmittelbare Wirksamkeit, unmittelbare Anwendbarkeit und Staatshaftung), worauf eine kritische Würdigung erfolgt, die sich z.B. mit der Problematik bereits bestehender völkerrechtlicher Verträge oder der Frage eines niedrigen Standards für alle (race to the bottom) beschäftigt. Nach diesem Teil wird die bestehende privatrechtliche Situation Österreichs dargestellt und mit jener der Richtlinie verglichen. Es werden jene Bereiche aufgezeigt, wo Adaptierungen notwendig sein könnten. Dabei werden folgende österreichische Gesetze herausgegriffen und analysiert: Allgemein bürgerliches Gesetzbuch, Handelsgesetzbuch, Konsumentenschutzgesetz, Gewerbeordnung, Signaturgesetz und Telekommunikationsgesetz. Eine Studie, die die Internetnutzung Österreichs analysiert, beendet die Arbeit.
