Der Begriff des Besitzes ist das Ergebnis einer langen Entwicklung, die mit den ersten Gesellschaften begann und bis heute andauert. Sein Charakter ist aufgrund der Elemente, aus denen er sich zusammensetzt, sehr heterogen, u. a. römischen und germanischen Ursprungs und des Gewohnheitsrechts. Es ist ein Weg, der ständig fortschreitet und sich ständig verändert, so dass man heute z. B. vom Besitz von Forderungen, Aktien und anderen immateriellen Gütern spricht. Diese Komplexität wirft viele Fragen über die Rolle des Besitzes in Bezug auf die heutige Gesellschaft auf. Um den heutigen Begriff des Besitzes jedoch umfassend verstehen und kennenlernen zu können, müssen seine Ursprünge und seine lange Entwicklung über die Jahrhunderte hinweg identifiziert werden. Um den heutigen Begriff des Besitzes zu untersuchen, ist es notwendig, sich auf die menschlichen Gesellschaften der Vergangenheit und ihre weitere Entwicklung zu beziehen. Dies geschieht, um die Rolle des Besitzes im positiven Recht zu verstehen, die ebenfalls von grundlegender Bedeutung ist.
