在當代文化治理的視野下,工業遺址已不再被視為單純承載歷史的靜態遺存,而是逐步轉化為能量匯聚與社會互動的公共場域。此類空間一方面連結歷史記憶、文化創意產業與公共參與,另一方面也檢驗制度在回應地方需求時的適切性。本書以《促進民間參與公共建設法》(下稱「促參法」)與《文化資產保存法》(下稱「文資法」)為分析核心,探討兩者在文化空間再生歷程中的角色定位與交互影響。促參法著重於藉由公私協力推動資源整合與治理效能;文資法則以保存與修復為基礎,確保文化資產的歷史價值獲得維繫。二者在制度邏輯上各具差異,卻在實際運作中相互交疊,既產生張力,也開啟制度創新與整合的契機。案例部分選取華山園區與雲門園區作為分析視窗。前者由閒置空間(工業遺址)轉化為都市文化樞紐;後者則透過基金會與專業團隊建構長期經營模式。兩者在法律依據、空間策略、治理方式上展現差異。不同制度選擇會影響保存深度、再利用強度與治理結構,並反映出中央、地方與民間之間的權責分配與互動關係。本書以文獻整理與法規分析為主要方法,回到制度文本與政策脈絡,釐清工具性規範與價值導向目標之間的矛盾與張力,並梳理雙法交錯時的關鍵節點,提出可能的調整方向。作者認為:文化場域的再生不應簡化為「保存」與「利用」的二元對立,而應透過治理設計追求兼顧的動態平衡。最後,本書提出三項建議:第一,在制度面建立明確的協作與審查機制,使保存原則與營運需求得以同步對話;其二,在操作面加強跨部會與地方參與,以提升決策過程的公開性與社會可及性;最後,導入永續性評估與階段性管理,以確保長期經營符合公共利益。綜上所述,本書旨在為文化資產保存、文化治理及閒置空間再利用提供具體參考,並希冀建構一座連結理論與實務的永續橋梁。梁昭玉自2014年起於國立臺北護理健康大學通識教育中心兼任講師,並擔任臺北榮民總醫院人體試驗委員會委員。畢業於國立臺灣師範大學藝術行政與管理研究所碩士,現為元智大學人文社會學院文化產業與文化政策博士學位學程生。長年於大學講授,研究專長涵蓋當代藝術、東西文化藝術賞析、文化資產保存與文化創意產業等核心課程。近年積極投入兩岸文化交流、藝術策展與學術論述,並於各大學研討會發表論文。近期策劃《藝術進入社區》與《知古鑑今》等展演計畫,推動藝術公共性與文化參與。除專業研究外,亦曾舉辦攝影個展及發表藝文評論,持續關注歷史空間再利用與文化治理之實踐議題。◇聯絡方式◇電郵︰chaoyu1010@gmail.com◇學歷◇元智大學 人文社會學院/文化產業與文化政策博士學位學程生(2018~)臺灣師範大學 藝術學院/藝術行政與管理研究所藝術學碩士(2008)◇現職◇榮總人體試驗委員會委員(2024.8~)國立臺北護理健康大學通識教育中心兼任講師(2014.9~)◇經歷◇國立臺灣戲曲學院 兼任講師(2021~2022)藝術活動主持人/藝術經紀(2021~)全球華人藝術網特派記者(2011)財團法人恆昶文教基金會暨恆昶攝影藝廊行政管理(1988~1999)◇任教科目◇教授「東西藝術賞析」、「當代藝術導論」、「文化創意產業」、「文化資產保存」
