Embora o terrorismo não seja explicitamente mencionado como um crime abrangido pela jurisdição do Tribunal Penal Internacional, pode, no entanto, ser julgado no TPI, interpretando-o como incluído no artigo 7º do Estatuto de Roma. O artigo 7º do Estatuto do TPI pode ser utilizado como base jurídica para julgar actos terroristas se estes preencherem os requisitos gerais do artigo. O texto do Estatuto de Roma não precisa de ser alterado para abranger os actos de terrorismo.
