A fragilidade do sistema jurídico chinês resulta, pelo menos em parte, das suas raízes confucionistas. Esta doutrina coloca o poder judicial em segundo plano, pelo que a correcta aplicação da lei depende da vontade do líder do Partido ou da administração. Assim, a alteração da Constituição da República Popular da China aprovada na primeira sessão do 13.º Congresso Nacional do Povo, em Março de 2018, aboliu o limite de dois mandatos para o Presidente. Enquanto detentora do poder público, a administração está numa posição de domínio. Enquanto ambas as partes mantiverem este modo de relacionamento, a equidade da justiça continua a ser utópica. Em suma, desde os tempos antigos até à actualidade, a China nunca conheceu um verdadeiro Estado de direito. O triunfo do valor moral sobre o valor jurídico, o triunfo da sanção moral sobre a sanção penal dominam o Império do Meio. A ordem humana e a ordem natural estão demasiado ligadas. Daí o desprezo por tudo o que ignora os vínculos particulares, por tudo o que permitiria a indução, a dedução, o raciocínio apenas pela lei e com base na igualdade.
