O direito a um ambiente saudável é uma preocupação internacional e nacional. A Declaração de Estocolmo de 1972 anunciou este direito. Uma série de tratados internacionais e regionais em matéria de direitos humanos e de ambiente menciona o carácter fundamental deste direito. A nível regional africano, os Estados africanos consagraram na Carta Africana dos Direitos do Homem e dos Povos o direito a um ambiente satisfatório e abrangente que conduza ao desenvolvimento de todos os povos. Preocupada com esta questão, a República Democrática do Congo não é um caso isolado e não fez ouvidos de mercador. Para demonstrar o seu empenhamento na defesa e promoção dos direitos humanos, consagrou na sua Constituição o direito a um ambiente saudável, propício ao pleno desenvolvimento de cada indivíduo.
