Este livro debruça-se sobre a questão da imunidade dos agentes do Estado perante os tribunais penais internacionais e, mais concretamente, perante o Tribunal Penal Internacional (TPI). Para o efeito, tomámos como ponto de partida um caso concreto, a saber, a questão de saber se a imunidade pessoal de Vladimir Putin pode ou não ser invocada contra ele enquanto Chefe de Estado que não é parte no Estatuto de Roma. Desde 17 de março de 2023, existe um mandado de captura contra ele por actos que constituem crimes de guerra. Esta situação levanta dois grandes problemas de direito internacional: por um lado, a questão de saber se a sua imunidade pessoal está ou não excluída pelo Estatuto de Roma (nº 2 do artigo 27º) e, por outro, se os Estados Partes no Estatuto de Roma têm ou não a obrigação de cooperar com o TPI (nº 1 do artigo 98º). É esta questão que foi analisada ao longo do presente estudo, em conformidade com o direito internacional positivo.
