A entrada em vigor do Estatuto de Roma, a 1 de Julho de 2002, suscitou grandes esperanças na luta contra a impunidade. No entanto, esta vontade da comunidade internacional esbarrou com a África, que constatou que este direito penal internacional punha em causa as imunidades diplomáticas e jurisdicionais, base do direito internacional tradicional. A jurisdição universal do Tribunal Penal Internacional confere ao Procurador o direito de processar todos os alegados autores de crimes, independentemente do seu estatuto oficial. Foi levantado um escudo de críticas ideológicas contra esta forma de justiça universal, devido à acusação de Chefes de Estado africanos activos. A rejeição desta justiça internacional é cada vez mais proclamada pelos dirigentes africanos nas suas instâncias internacionais. Estamos todos preocupados com o futuro desta nova forma de justiça e com os direitos das vítimas.
